ASSUMPTION OF RISK/WAIVER OF LIABILITY
​ASSUMPTION OF RISK
I understand that there are risks associated with my participation in the Event, such as physical and/or psychological injury, pain, suffering, illness, death, or economic loss. These injuries or outcomes may arise from my own or other’s actions, inactions, or negligence, or the condition of the Event location or facility. Nonetheless, I assume all risks of my participation in the Event, whether known or unknown to me, including travel to and from the Event or any events incidental to the Event.
RELEASE AND WAIVER OF LIABILITY
I hereby agree on behalf of myself (and my assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives) to release from liability the Indian Health Council, Inc. and its member Tribes, and partners, their employees, officers, volunteers, and agents (collectively, the “Releasees”) from any and all liability resulting from any personal injury, accident or illness (including death), and/or property loss, however caused, arising from, or in any way related to, (i) my participation in the Event, travel to and from the Event, or any events incidental to the Event, (ii) the negligence or other acts, whether directly connected to the Event or not, and however caused, by any Releasee, or (iii) the condition of the premises where the Event occurs, whether or not I am then participating in the Event. I also agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with the Event.
INDEMNIFY AND HOLD HARMLESS
I also hereby agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives will INDEMNIFY, DEFEND, AND HOLD the Releasees HARMLESS from any and all claims, loss or damage to my personal property, actions, suits, costs, expenses, damages and liabilities including, but not limited to, attorney’s fees, arising from, or in any way related to, my participation in the Event. If the Releasees incur any of these types of expenses, I agree to reimburse the Releasees.
SEVERABILITY
I expressly agree that the foregoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by applicable law, and that if any portion thereof is held invalid or unenforceable, I will continue to be bound by the remaining terms.
